If your Salary qualify for H-1 then there should be no problem. The main issue is if the position requires advance degree. If your company applied your H-1 for position only require bachelor degree (you should be able to find this out by checking your H-1 application), then you might not be able to take advantage of EB-2 since they very likely will use the job description to apply for green card. I think what your company might have done is to apply your H-1 with bachelor degree as requirement, so they can lower the salary requirement. ' j; z. }# _: W2 \3 ^

The first step of applying green card (PR) is to apply labor cert. There is a minimum salary requirement base on location and position. This might be what your company is referring to as salary level. You can check Department of Labor to find out the list (www.dol.gov). You should try to negotiate with your company if they are willing to create a new position for you to apply Green Card with EB2; however, most big company will not agree to do this.
