distractions and reinforce safety.
Smoking with Minor Passengers (SB 7, Oropeza) January 1, 2008. This law prohibits anyone in a vehicle, not just the driver, from smoking when there are children younger than 18 present. This law applies whether the vehicle is
stopped or is moving. It is a secondary violation.
An officer cannot stop a driver to determine if they are in violation. Those caught violating the law will face up to a $100 fine. California is the third state to ban smoking in
cars carrying minors, but the first with a policy that protects all children under 18. In 2006, Arkansas and Louisiana passed laws banning motorists from smoking in cars with children up to age 6 and 13 years old, respectively. |
