Just to reiterate the salary cap requirement. It's set by Department of Labor base on job location and title. It changes every year base on the annual report of each labor departments. During the green card application process, it is not necessary that the INS will check the applicant's current salary. But if INS requested proof of income. then one better can come up with pay stubs meets the minimum requirement of the job position define by the DOL, or the application will most likely be declined. The minimum requirement can be 30k, 60k, 100k or whatever amount. Therefore, it's NOT up to the lawyer to say whether applicant with salary of 50k of more has better chance to be granted green card.
