Wireless Telephones (SB 1613, Simitian) (Vehicle
Code §23123) July 1, 2008. This law makes it illegal to use a cell telephone while driving, unless the phone is designed and configured to allow hands-free listening and talking operation and is used in that manner. It will be
legal to use a Blue Tooth or other earpiece, however you cannot have BOTH ears covered. The law provides an
exemption for emergency purposes, and for those operating a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way radio operated by a push-to-talk
